Abstract

This article examines the legal and institutional frameworkthat governs asset recovery in the country. It is through thisframework that criminal justice is administered in relationto asset recovery. It undertakes an in-depth analysis of thelaws and institutional framework that deal with assetrecovery. The main focus is identifying the roles of keyinstitutions in the processes and mechanisms aimed atenabling recovery of proceeds and instrumentalities ofcrime under the existing law. In the course of the discussion,legal provisions that provide the procedures through whichasset recovery should be undertaken are appraised. Thearticle reveals that there are challenges in the legal andinstitutional framework that governs asset recovery in thecountry thereby affecting its performance.Recommendations are made in order to remedy thesituation.Keywords: proceeds of crime, legal and institutional framework, asset recovery,Tanzania.
