Abstract
This article analyses the legal framework protectingvictims of trafficking in South Sudan. It discusses theinternational framework from human rights law andanti-WUDIILFNLQJ VSHFLILF LQVWUXPHQWV RQ YLFWLPV·protection. It then offers a critical study of the SouthSudanese legal framework on trafficking. It establishesthat South Sudan criminalises some forms of traffickingand protects victims. The article, however, notes thatSouth Sudanese legal framework fails to criminalisetrafficking comprehensively and does not protectvictims sufficiently. Its provisions obfuscate protectionaspects that international law establishes. Its poor andfragmented manner of criminalising trafficking equallycontributes to ineffective protection. It is noted thatlack of a sectoral legislation is largely responsible for theensuing legal dilemma. The main recommendation isthat South Sudan should ratify the Organized CrimeConvention and its Anti-Trafficking Protocol and enacta specific legislation to protect victims of trafficking andremove the existing confusion
