Abstract

The article analyses 7DQ]DQLD·V /RFDO CRQWHQW Regulationswith a view to establishing the extent to which the objectivesbehind the local content requirements can be achieved. Itfinds regulatory and practical controversies which, if notaddressed, stand to inhibit the realisation of the intendedobjectives. These challenges include: (i) unrealistic andunreasonable requirements which necessitate every goods orservice provider to comply with the Regulations, thus likelyto frustrate the mining industry; (ii) stringent complianceregulatory requirements without regulatory clarity; and (iii)inconsistency between the Regulations and the parent Act,the Mining Act in this regard. The article argues that in a bidto realise the objectives behind local content requirements,the Regulations should be amended with a view to creatingan enabling-environment through which the objectivesbehind local content requirements can be achieved whileensuring viability of investments.
