Abstract

Stakeholder engagement is necessary to foster responsiblemining practices that minimise negative environmental andsocial impacts. This study exami ned whether Tanzania’s CSRlegal framework is effective in promoting meaningfulstakeholder engagement in the mining sector. Doctrinal andcomparative legal analyses were employed to evaluate theframework’s clarity, consistency and compliance withinterna tional standards. The findings highlight thatTanzania’s CSR legal framework has significant gaps andlimitations, such as a lack of direct consultation with localcommunities, monitoring and evaluation mechanisms,consequences for non compliance, criteria for prioritydetermination, and the presence of statutory bureaucraticprocesses. These deficiencies impair not only effectivestakeholder engagement but also compliance withinternational standards in supporting sustainable miningpractices. Therefore, i t is argued that, despite commendablelegislative efforts by Tanzania to foster CSR stakeholderengagement, strategic legislative reforms are needed topromote responsible mining practices.
